Cboe Files Lawsuit Challenging CFTC Approval of Individual Stock Perpetual Derivatives

On November 4, according to a Cboe announcement, Cboe has joined a legal action initiated by the Capital Markets Alliance (CMA) challenging the Commodity Futures Trading Commission's (CFTC) approval of perpetual derivatives for U.S. stocks and ETFs, and is seeking injunctive relief. CMA members include Cboe, Citadel Securities, and the Healthy Markets Association.

Cboe CEO Craig Donohue stated that securities-related products should be traded on registered securities platforms and be subject to investor protection and regulatory oversight mandated by U.S. securities law. Previously, the CFTC announced that individual stock perpetual futures could begin trading on qualified U.S. exchanges.
